CJP Questions SC on Election Role; PTI Contempt Proceeds

Chief Justice of Pakistan (CJP) Qazi Faez Isa raised concerns during a hearing regarding the Pakistan Tehreek-e-Insaf (PTI) plea seeking contempt proceedings against the Election Commission of Pakistan (ECP). The CJP emphasized the Election Commission’s responsibility in election matters and questioned the need for the Supreme Court’s intervention.

Key Points from the Hearing:

Live Broadcast and Bench Composition: The three-member bench, led by CJP Isa and including Justice Muhammad Ali Mazhar and Justice Musrat Hilali, heard the PTI’s plea. The proceedings were broadcast live on the SC’s website and YouTube channel.

PTI’s Allegations and SC Notices: PTI lawyer Latif Khosa presented arguments on alleged harassment of candidates. In a previous hearing, the SC issued notices to Punjab’s IGP, chief secretary, and advocate general regarding PTI’s allegations.

ECP’s Response and PTI’s Subsequent Plea: Following the SC’s directive, the ECP met the PTI delegation to address concerns. Despite assurances, the PTI filed another contempt plea on December 26, alleging the ECP’s failure to ensure a level-playing field.

Section 144 and MPO Complaints: PTI counsel Khosa claimed adverse actions under Section 144 and MPO against party members. CJP Isa clarified that these have not been challenged before the court.

Supreme Court’s Role: The CJP reminded PTI that the Supreme Court is not a political forum, urging the party to use appropriate forums for political purposes.

Election Mandate: CJP Isa reiterated that the Election Commission’s mandate is to conduct elections and urged respect for established institutions.

Hearing Conclusion: The SC ordered PTI to submit its response to the ECP’s plea and adjourned the hearing until January 15.
