PTI Submits Affidavits of MNAs to ECP per Supreme Court Order

Pakistan Tehreek-e-Insaf (PTI) has complied with the Supreme Court’s directive in the reserved seats case by submitting affidavits for 25 out of 41 Members of the National Assembly (MNAs) to the Election Commission of Pakistan (ECP). This confirmation of their affiliation with PTI marks a significant step in addressing the legal requirements set forth by the Supreme Court. PTI Chief Barrister Gohar Ali Khan announced this development on Sunday, adding that the affidavits for seven more MNAs would be submitted shortly.

The Supreme Court issued a landmark verdict on Friday in the reserved seats case, directing the ECP to verify the party memberships of 41 PTI MNAs. According to the apex court’s decision, 39 of the 80 MNAs were officially recorded as PTI members by the ECP, while the remaining 41 were listed as independents. The court’s order emphasized the necessity of clarifying the party affiliation of these MNAs to ensure compliance with the provisions of Article 51 of the Constitution.

The Supreme Court’s order stated, “In the peculiar facts and circumstances of the general election of 2024, it is declared that out of the aforesaid 80 returned candidates (now MNAs) those being 39 – in respect of whom the commission has shown PTI in any one of the aforesaid columns in the list, were and are the returned candidates whose seats were and have been secured by the PTI within the meaning, and for purposes of, para 5 above in relation to the Article 51 provisions.”

Additionally, the court directed that the remaining 41 MNAs, who were listed as independents, must submit notarized statements within 15 working days, confirming their candidacy under PTI during the general election. The order read, “In the peculiar facts and circumstances of the general election of 2024, it is further ordered that any of the remaining 41 returned candidates out of the aforesaid 80—may, within 15 working days of this order file a statement duly signed and notarised stating that he or she contested the general election as a candidate of the political party specified therein.”

Once these statements are filed, the ECP is required to notify the relevant political party within seven days and request a confirmation that the candidate contested the election as its representative. This process ensures transparency and adherence to legal standards, preventing any ambiguities regarding party affiliations.

Barrister Gohar Ali Khan assured the media that PTI is committed to fulfilling the court’s requirements. The affidavits for the remaining MNAs will be submitted shortly, ensuring complete compliance with the Supreme Court’s directive. This move is seen as a proactive step by PTI to address any potential legal challenges and affirm the legitimacy of their MNAs’ positions.

The Supreme Court’s decision and PTI’s subsequent actions have significant political implications.
