Supreme Court Petition Urges Reevaluation of Dr. Arif Alvi’s Presidential Role

Ghulam Murtaza Khan filed a petition on Saturday urging the Supreme Court to reassess Dr. Arif Alvi’s continuation as the President of Pakistan, citing concerns over his controversial role. The petition, filed under Article 184(3) of the constitution, designates the secretary to the president and the secretary of the Ministry of Law and Justice as respondents.

The petitioner contends that President Alvi is not fulfilling his duties in line with the requirements of the office. Alleging a misuse of powers and violations of the constitution through words and actions, Khan argues that Dr. Alvi is not entitled to remain in the esteemed position of Head of State.

Highlighting specific incidents, the petitioner notes that in April 2022, President Alvi dissolved the National Assembly on the instructions of former Prime Minister Imran Khan, resulting in adverse political consequences and damage to Pakistan’s international image. Additionally, it is asserted that the president failed to adhere to the constitutional mandate by not providing an election date.

The petitioner further accuses President Alvi of exhibiting bias towards the Pakistan Tehreek-e-Insaf (PTI) and misusing the President’s Office for PTI meetings and activities, deeming such actions unconstitutional. The failure to sign the Official Secrets Amendment Bill and Pakistan Army Amendment Bill 2023 is cited as grave misconduct and evidence of partiality.

The petition contends that President Alvi’s controversial statements and contradictions, including a tweet denying the signing of certain bills despite confirmation from his secretary, have eroded trust in his character. Allegations of violations of Article 5 and 12 of the Constitution further contribute to the argument against his eligibility to continue as president.

Referencing past judgments, the petition emphasizes that the superior courts have observed President Alvi’s failure to fulfill his constitutional role. The petitioner argues that these instances of constitutional violations and gross misconduct warrant a declaration that Dr. Arif Alvi should not continue as the President of Pakistan. The Supreme Court now holds the key to determining the future course of the presidency in light of these allegations.
